Web Design Terms of Service Agreement

This Terms of Service Agreement (“Agreement”) is a legally binding contract between CertiDesign (“we,” “us,” or “our”) and you (“Client,” “you,” or “your”) governing the use of our website design services.

1. Acceptance of Terms

By engaging our services, you agree to be bound by this Agreement, our Privacy Policy, and any additional terms applicable to certain programs in which you may elect to participate. If you do not agree to these terms, you must cease using our services immediately.

2. Service Description

CertiDesign offers custom website design and development services, including content creation and fast track options for expedited delivery.

3. Payment Terms

  • An initial deposit of 50% of the total service fee is required to initiate the project.
  • The remaining balance is due within two (2) working days following the date the website becomes publicly accessible (“Launch Date”).

4. Client Cooperation

  • Clients are expected to provide timely responses to our inquiries, particularly regarding content decisions, within five (5) business days.
  • Failure to comply with this requirement may result in project delays and additional fees.

5. Fast Track Service

  • The fast track service necessitates client responses within forty-eight (48) hours.
  • Non-compliance will negate the fast track status and revert the project to standard delivery schedules. The fast track fee is non-refundable.

6. Content Creation and Approval

  • Our content creation service includes up to three (3) rounds of revisions.
  • Requests beyond the included revisions will incur additional charges at our standard rate.

7. Project Completion and Final Payment

  • The project is deemed complete upon the Launch Date when the website is operational and publicly accessible.
  • The final payment is due within the aforementioned two (2) working day period post-Launch Date.

8. Penalties for Client-Induced Delays

  • Delays attributable to the client’s inaction or delayed responses will incur a penalty of 5% per week of the total project cost, accruing weekly until the outstanding requirements are fulfilled.

9. Cancellation and Refunds

  • Written notice is required to cancel services.
  • The initial deposit is non-refundable once the project has commenced.

10. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles.

11. Dispute Resolution

Any disputes arising out of or related to this Agreement shall be resolved through binding arbitration in accordance with the rules of the United Kingdom.

12. Modifications to Terms

We reserve the right to modify these terms at any time. Your continued use of our services after any such changes constitutes your acceptance of the new terms.
